A California judge has dismissed Byron Allen $100 million lawsuit against McDonald’s, filed last year, alleging the fast-food giant broke its commitment to increase advertising spending with Black-owned media. The judge claimed that Allen’s legal materials did not show a likelihood of proving the assertions in court. Another $10 billion lawsuit by Allen, claiming racial discrimination in advertising practices, remains active in federal court. The lawsuit focused on McDonald’s 2021 pledges to boost spending on diverse-owned media, with the judge stating McDonald’s cannot be sued over a press release commitment.
